環署：蜜月灣開發商無權占海岸

（中央社記者許秩維台北2014年7月9日電）環保署今天說，根據宜蘭蜜月灣開發計畫環評審查結論和最高行政法院裁判，蜜月灣開發單位無權私自占有海岸。

媒體報導，位在宜蘭大溪國小旁的戲水勝地蜜月灣，傳出羅許建設與博愛企業4月提出「蜜月灣整體開發計畫」，未來計劃在此蓋旅館和別墅，遊客親水權恐遭剝奪，猶如台東美麗灣翻版。

環保署表示，宜蘭大溪蜜月灣地區開發計畫環評審查過程，都有邀宜蘭縣政府參與審查會議表達意見，而「民眾親水權」議題，也是環評審查過程中關切的重要事項，審查結論也載明「本開發案不得阻礙民眾對海岸的公共通行權與親水權」，開發單位必須依審查結論執行 。

由於開發單位認為無法據以辦理，因此依法提起救濟。環保署表示，台北高等行政法院於民國96年判決開發單位敗訴，最高行政法院民國98年也裁判確認，維持環保署所作的決定，因此開發單位無權私自占有海岸。
